ACA Ruling Update

Many people are wondering when we will hear an ACA Ruling update on the case regarding for Obamacare. Oral arguments were heard in New Orleans at the 5th Circuit Court of Appeals on July 9, 2019. Typically, it will take several months before the court releases its opinion.

So what does this mean? Currently, we are waiting to hear what the court will decide. There will not be much, if any, information available during the waiting period. Any updates will be provided at our dedicated update page.

Are there any indications how the court will rule?

While we do not have a decision, we do have some hits as to how the court is leaning based on what happened during oral arguments. During the hearing, a panel of three judges sat through 90 minutes of arguments. The court kept going back to the original constitutionality of the ACA regarding the original mandate. Many news outlets speculate that the court is leaning towards striking the law altogether which was the original ruling in December 2018.

What Happens if we lose Obamacare?

The man question on people’s minds now is what will happen if there is no longer the ACA? There is no simple answer to this question. Congress has failed to provide a replacement plan for healthcare. In the current partisan climate, there seems to be little hope of any real reform happening on the legal side.

If the Affordable Care Act is struck down, the provisions that the law added, such as coverage for pre-existing conditions, will cease. How this will affect individuals remains to be unseen. We do not know what insurance companies, as well as individual states, might do in the absence of the ACA. Any thoughts on this would be pure speculation.
